1. Accuracy of Information
1.1 General
Tourism Top End provides the content on this website as a service to visitors and to promote tourism products in Northern Australia.
1.2 No Warranty
We rely on information supplied by Travel Operators and while we take care to ensure information is current at the time of publication, we cannot guarantee accuracy, completeness, or availability. You are responsible for confirming details directly with the Travel Operator before making decisions or bookings.
2. Prices and Conditions
2.1 Prices
• Prices displayed are in Australian Dollars (AUD) and include GST where applicable.
• Prices are subject to change without notice due to seasonal variations, fees, taxes, or supplier charges.
• Prices generally exclude personal expenses, meals, transfers, and levies unless stated otherwise.
2.2 Changes by Travel Operators
If a Travel Operator changes or withdraws any part of your booking beyond our control (e.g., overbooking), we will notify you as soon as possible.
If a Travel Operator cancels a booking due to unforeseen circumstances, you will be refunded the amount paid, less any non-refundable credit card surcharge fees.
3. Booking Conditions
3.1 Our Role as Agent
Tourism Top End acts solely as an agent for Travel Operators supplying tours, accommodation, tickets, transport and other services (“Products”).
Your contract is directly with the Travel Operator supplying the Product.
3.2 Customer Details & Responsibility
• You must be 18 years or older to make a booking.
• You must provide your full name, email address, contact phone number, state, postcode and country of residence, and valid payment details.
• You are responsible for providing accurate and current information at the time of booking. We accept no liability for any incorrect information submitted.
• Once payment is processed, your booking details are forwarded to the Travel Operator and you will receive confirmation (typically by email).
3.3 Online Bookings
• Full payment is required at the time of purchase.
• If your booking is “on request,” it is not yet confirmed, and your credit card will not be charged until the Travel Operator confirms your booking. Once confirmed, payment will be taken accordingly.
• Once payment is processed, your booking details are issued by email.
3.4 Telephone and In-Centre Bookings
• A 30% deposit is required at the time of booking.
• The balance is due 30 days prior to travel.
• Bookings made within 30 days of travel require full payment at the time of booking.
3.5 Secure Payments
Online payments via BookEasy™ are processed using SecurePay, a trusted payment gateway employing industry-standard encryption to protect your payment information.
By using BookEasy™ to make payments, you agree to the terms and conditions of the payment gateway provider and to the collection of any personal information required to process your payment.
4. Cancellations, Amendments & Fees
4.1 Customer Cancellations
• Cancellations to confirmed itineraries incur a $50 AUD (inc. GST) administration fee. This is in addition to any fees or charges imposed by the Travel Operator.
4.2 Amendments
• Changes to confirmed itineraries incur a $25 AUD (inc. GST) amendment fee per change.
4.3 Travel Operator Policies
The Travel Operator’s own cancellation and amendment terms apply in full and may vary between operators. The Travel Operators' policies can be found on their individual operator page on the www.visittopend.com.au website.
4.4 Credit Card Fees
All card payments attract a 1.5% non-refundable surcharge.
5. Refunds
• Refunds will be processed as quickly as possible; however, allow up to 7-14 days in some cases.
• Refunds may only be returned to the original payment method or to a nominated bank account.
• In some situations, a 12-month travel credit may be offered as an alternative to cancellation, assessed case-by-case.
6. Responsibility and Liability
6.1 Travel Operators
• We do not control the supply of Products.
• We are not liable for any loss, delay, additional expense, injury, accident, or cancellation caused by a Travel Operator or external factors, including but not limited to weather, government restrictions, or operational issues.
6.2 Mandatory Consumer Rights
Nothing in these terms excludes rights granted to consumers under the Competition and Consumer Act 2010 including the ACL. Where a failure of goods or services is considered major, you may be entitled to a replacement, refund, or compensation.
7. Insurance
We strongly recommend that customers take out appropriate travel insurance to protect against cancellation, illness, personal injury, or loss of property.
8. Intellectual Property
All content on this website including text, images, videos, and branding is protected by copyright, trademarks, or other IP rights.
Material may not be reproduced without written permission except as permitted by law.
9. Third-Party Links
This website may include links to external sites. Tourism Top End does not endorse or take responsibility for the content or operation of those sites. Access is at your own risk.
10. Disclaimer and Indemnity
To the full extent permitted by law:
• Tourism Top End disclaims liability for any loss or damage arising from your website use, reliance on information, or the actions of Travel Operators and third-party websites.
• You agree to indemnify us against any claims arising from your use of the website or breach of these terms.
11. Jurisdiction
These terms are governed by the laws of the Northern Territory of Australia and you submit to the non-exclusive jurisdiction of the NT courts.
